Terms and conditions of sale

Version in force as of [DATE TO BE ADDED]. These terms apply to every order placed on shop.piksite.fr.

Article 1 — Identity of the seller

The seller is Alexandre Prouteau, sole trader, SIRET 91052976700022, whose registered office is at [STREET ADDRESS TO BE ADDED], 86130 Dissay, France, operating the online shop under the trading name Confort Cars. Full contact details appear in the legal notice.

Article 2 — Purpose and scope

These terms and conditions of sale govern distance sales of car accessories between the seller and any consumer buyer, to the exclusion of any other terms. Placing an order constitutes unreserved acceptance of these terms.

The seller reserves the right to amend them at any time; the terms that apply are those in force on the date of the order.

Article 3 — Products

The essential characteristics of each product appear on its product page. Photographs are illustrative: a difference in shade or rendering caused by your screen does not engage the seller's liability.

Products are offered subject to availability with our suppliers. Where unavailability comes to light after the order, the buyer is informed without delay and refunded in full within fourteen days.

Article 4 — Prices

Prices are shown in euros, inclusive of all taxes. VAT is not applicable pursuant to article 293 B of the French General Tax Code.

Delivery is free of charge for mainland France, with no minimum order. Nothing is added at the payment stage: the amount shown on the product page is the amount due.

Import taxes applicable to products shipped from outside the European Union are settled upstream. The buyer has no customs charges to pay on delivery.

Article 5 — Ordering

An order follows these steps: selecting the product and its variant, adding it to the basket, reviewing the summary, entering delivery details, choosing a payment method, then confirming.

Confirming the order implies acceptance of these terms and creates an obligation to pay. A confirmation email summarising the order is sent to the address given by the buyer. The contract is formed on receipt of that email.

The seller reserves the right to refuse an order that is manifestly abnormal, made in bad faith, or placed by a buyer with whom a payment dispute is ongoing.

Article 6 — Payment

Payment falls due when the order is placed. It is made by bank card through our payment provider, which alone collects and processes card data. At no point does the seller have access to your card number.

The order is only processed once payment has actually been authorised.

Article 7 — Delivery

Products are delivered to the address given by the buyer when ordering, within mainland France.

Processing time: 24 working hours. Estimated delivery time: 10 to 20 working days from dispatch. This is longer than a sale from local stock because products ship from the manufacturer's warehouse; it is stated before purchase and repeated in the confirmation email. A tracking number is provided as soon as the parcel ships.

Under article L.216-2 of the French Consumer Code, where the stated delivery date is exceeded, the buyer may give the seller formal notice to deliver within a reasonable period and, failing that, terminate the contract and be refunded all sums paid within fourteen days.

On delivery it is for the buyer to check the condition of the parcel and to report any damage to the carrier and to the seller, ideally within three days.

Article 8 — Right of withdrawal

The consumer buyer has fourteen days from receipt of the product in which to exercise the right of withdrawal, without having to give reasons and without penalty.

To exercise it, send an unambiguous statement to the seller's email address before the deadline expires. The model withdrawal form reproduced below may be used, but is not compulsory.

The product must be returned complete, in a resaleable condition, within fourteen days of the notification. Return postage is borne by the buyer, in accordance with article L.221-23 of the French Consumer Code.

The refund is made within fourteen days of recovering the product or of proof of its dispatch, using the same payment method as the order.

Article 9 — Statutory guarantees

Independently of any commercial warranty, the seller remains bound by:

  • the statutory guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code), which entitles the buyer to repair or replacement of a non-conforming product for two years from delivery, free of charge and without having to prove the defect;
  • the guarantee against latent defects (articles 1641 et seq. of the French Civil Code), for two years from discovery of the defect.

These guarantees are exercised with the seller, at the email address given in the legal notice. They do not cover normal wear, use inconsistent with the product's purpose, or damage resulting from unsuitable fitting.

Article 10 — Liability

The products sold are accessories. It is for the buyer to check that they are compatible with their vehicle and to ensure that fitting them does not interfere with driving, visibility or the operation of safety equipment, airbags in particular. The seller cannot be held liable for unsuitable fitting.

Article 11 — Personal data

The data collected is necessary to process the order, to deliver it and to meet accounting obligations. How it is handled is detailed in the privacy policy.

Article 12 — Disputes and mediation

In the event of difficulty, the buyer is invited to contact the seller first, so that an amicable solution can be sought.

Failing agreement, the consumer buyer may refer the matter free of charge to the consumer mediator whose details appear in the legal notice, or use the European online dispute resolution platform.

These terms are governed by French law. Failing an amicable settlement, any dispute falls to the competent French courts.
